1. Introduction
Welcome to Pearl of Ceylon (Pvt) Ltd. By booking or using our tourism services, you agree to comply with and be bound by the following Terms and Conditions. These terms govern all bookings, services, and interactions with Pearl of Ceylon (Pvt) Ltd, registered in Sri Lanka.
2. Services Provided
- Guided tours, travel packages, and excursions within Sri Lanka.
- Hotel reservations, transport arrangements, and activity bookings.
- Customized itineraries for international and local clients.
3. Booking and Payment
- All bookings must be confirmed in writing (email or official booking form).
- A deposit of 40% is required at the time of booking; the balance must be paid no later than 14 days before arrival.
- Payments can be made via bank transfer, credit card, or other approved methods.
- The client must pay all bank charges in the case of a bank transfer.
- No additional postage fees, booking fees, or hidden charges will apply.
- Exchange rates are based on the Central Bank of Sri Lanka at the time of booking and are not subject to change.
4. Cancellations and Refunds
- Cancellations made 40 days prior to arrival: full refund of deposit.
- Cancellations made 15–29 days prior: 50% refund of deposit.
- Cancellations within 14 days: no refund.
- No refunds for early checkouts, no-shows, or unused services once the tour has commenced.
5. Changes to Itinerary
- Pearl of Ceylon reserves the right to adjust itineraries due to weather, safety, or unforeseen circumstances.
- Clients will be informed promptly, and alternative arrangements of equal value will be offered.
6. Responsibilities of Clients
- Clients must ensure they hold valid passports, visas, and travel insurance.
- Clients are responsible for their personal belongings during tours.
- Any misconduct, illegal activity, or violation of local laws may result in immediate termination of services without refund.
- Clients will reimburse Pearl of Ceylon or its suppliers for any damage caused by negligent or reckless behavior.
7. Special Requests
- Any special requests (dietary needs, room preferences, facilities, etc.) must be advised at the time of booking and confirmed by email.
- While every effort will be made to accommodate reasonable requests, Pearl of Ceylon cannot guarantee fulfillment.
- Failure to meet a special request will not constitute a breach of contract.
8. Liability
- Pearl of Ceylon acts as an agent for hotels, transport providers, and activity operators. We are not liable for accidents, delays, or losses caused by third parties.
- We are not responsible for natural disasters, political unrest, or other force majeure events.
- Clients must obtain comprehensive travel insurance.
9. Health and Safety
- Clients must disclose any medical conditions that may affect participation in tours.
- Pearl of Ceylon reserves the right to refuse participation if safety is at risk.
- Adventure activities (e.g., hiking, diving, safaris) are undertaken at the client’s own risk.
10. Privacy & Data Protection
- Personal information provided during booking will be used solely for travel arrangements and will not be shared with unauthorized third parties.
- Pearl of Ceylon complies with Sri Lankan data protection regulations and, where applicable, international standards such as GDPR.
11. Governing Law & Jurisdiction
- These Terms and Conditions are governed by the laws of Sri Lanka.
- Any disputes shall be subject to the exclusive jurisdiction of Sri Lankan courts.
12. Intellectual Property
- All content on Pearl of Ceylon’s website, brochures, and marketing materials is the property of the Company.
- Unauthorized reproduction, distribution, or use of content is prohibited.
- Pearl of Ceylon’s brand name, logo, and slogans are protected trademarks.
13. Amendments
- Pearl of Ceylon reserves the right to amend these Terms and Conditions at any time. Updated versions will be published on our official website.
14. Force Majeure
Pearl of Ceylon shall not be liable or responsible for any failure or delay in performance arising out of or caused by circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, epidemics, strikes, airline disruptions, or government actions.
15. Dispute Resolution
In the event of any dispute, the parties agree to attempt resolution through mediation or arbitration in Colombo, Sri Lanka, prior to initiating court proceedings.
16. Insurance Requirement
All clients must obtain comprehensive travel insurance covering medical expenses, cancellations, and personal liability. Proof of insurance may be requested prior to travel.
